This Decree enters into force of 21 May 2015.
Abstract

This Regulation determines the procedure for granting to legal entities, citizens, including individual entrepreneurs, surface water bodies - ponds and watered quarries on lease for fish farming. It shall not apply to legal entities engaged in the cultivation and breeding of commercial fish and fish-stocking material of which the Republic of Belarus and (or) the administrative-territorial units holding shares (stakes in authorized funds), can influence the decisions taken by these legal entities. Surface waterbodies can be leased for fish farming in accordance with the national integrated scheme for placing ponds and watered pits suitable for fish farming approved by the Ministry of Agriculture and Food in agreement with the State Inspectorate for the Protection of Flora and Fauna under the President of the Republic of Belarus and this Regulation on the basis of decisions taken by local Councils of Deputies. Lease of surface waterbodies for fish farming shall be regulated by contracts. Lease of surface waterbodies for fish farming shall be prohibited in the following cases: (a) for waterbodies included in the national integrated scheme for the allocation of fishing areas; (b) for waterbodies allocated for separate water use for domestic, potable water supply, hydropower and defense needs; (c) for waterbodies located in full or in part on the territory of inhabited areas; (d) for waterbodies located on the territory of rare and typical biotopes, habitats of animals and places of growth of plants belonging to the species included in the Red Book of the Republic of Belarus or protected in accordance with international treaties of the Republic of Belarus; and (e) for waterbodies that are not included in the national integrated scheme for placing ponds and watered quarries suitable for fish farming.
