Abstract

This Decree approves the Regulation for Protection of New Varieties of Plants. This Regulation, consisting of 10 Chapters and three Annexes, establishes rules and requirements to be met for all species of plants, specifying that the protection of plant breeder's rights is valid in the country and in all countries with which Mozambique has established bilateral and multilateral agreements on the subject. In addition, it defines composition, duties and powers of the Registration Authority, entitled to carry out the registration of plant breeder's and regulate the conditions for issuing the grant of rights, the evaluation of applications, licenses, assignment and transfer of rights, waivers, and cancellation of the plant breeder's rights, as well as inspection fees, penalties and appeal for illegal activities.
