Abstract

This Decree has been enacted in order (i) to control the utilization of land in general; (ii) to settle the problems in the field of land affairs; and (iii) to review the position, tasks, and functions of the Directorate General of Agrarian Affairs, and to upgrade it to an institution which handles land affairs on a national level: the National Land Affairs Agency. This is a non-departmental government institution which is positioned under the President of the Republic. It has the task of assisting the President in the management and development of land affairs administration, as well as performing the following functions: to formulate policies and plans for land control and utilization, and for landownership regulation; to execute the measuring, charting and registration of land; to conduct research and development in the field of land affairs; etc. The Agency is led and managed by a Head, who is seconded by a Deputy for the General Affairs Sector; a Deputy for the Regulation, Control, and Land Utilization System Sector; a Deputy for the Land Rights Sector; a Deputy for the Land Measurement and Registration Sector; a Deputy for the Supervision Sector. The Agency also includes a Research and Development Center and an Education and Training Center. Furthermore, if need be, it may appoint expert staff. In addition, the Agency has Regional Offices, which are vertical agencies located at every provincial capital. These constitute an operational deconcentration apparatus subordinated to the Governors as Heads of the Regions. As to the budget of the Agency, it is to be charged to the State Revenue and Expenditure Budget.
