Abstract This Decree, composed of 38 articles, regulates the implementation of Law No. 9.456 on protection of plant varieties and establishes the Plant Varieties Protection Service - SNPC, the aim of which is to protect intellectual rights regarding plant varieties through the granting of a Plant Variety Protection Certificate. This agency under the Ministry of Agriculture and Supply, is responsible for the protection of plant varieties in the Country. Competencies and procedures of the National Plant Varieties Protection Service (SNPC) are specified in the text,. It introduces a National Register of Protected Plant Varieties and a compulsory license to allow the exploration of a protected plant variety at the request of a legitimately interested party with or without the permission of the holder of the rights.
