Abstract

This Decree establishes the Regulation prohibiting the capture, commercialization, export, import and re-export of some marine species, as well as the protection of other marine species. The Regulation, consisting of 9 articles and two Annexes, establishes the regime of prohibition and sanctions applicable to some species from illegal, unreported, unregulated or unauthorized fishing by the Fisheries Sector, from sea products and aquatic ornamental organisms, as well as regulating the regime for protection and sanctions applicable to some fisheries species. It applies to national or foreign natural persons, national or foreign legal entities operating, both in the national territory, inland and archipelagic waters and in the territorial sea, as well as in the Contiguous Zones, adjacent to the territorial sea and the Exclusive Economic Zone. Fishing, marketing, transport, transformation or processing, export, import and re-export, including products derived therefrom, are prohibited from the following species: a) Corals; b) Ornamental aquatic species; c) Sea cucumbers; d) Seahorse. The export of octopus greater than 10 kg by a natural or legal person is also prohibited.
