Abstract

This Decree establishes the Procedure for conducting special control of persons applying for positions that involve holding a responsible or particularly responsible position and positions with high corruption risk. A special control shall be carried out on persons applying for positions that involve holding a responsible or particularly responsible position, and positions with increased corruption risk (except for cases envisaged by law), including Information and data submitted in person. It lists the official positions subject to control for the purpose of corruption risk assessment. The following information and data shall be subject to mandatory special control: (a) existence of a court decision that has entered into force, according to which the person was prosecuted, including for corruption offence, as well as the presence of a criminal record, its removal, cancellation; (b) the person was charged with and convicted of administrative corruption-related offences; (c) the accuracy of the information specified in the declaration of the person Authorized to perform the functions of the state or local self-government; (d) attribution to a person of corporate rights; 5) state of health (in terms of the person's registration at psychoneurological or narcological health care institutions), education, availability of a scientific degree, academic title; (e) military service status; (f) access to state secrets required in accordance with the qualification requirements for a particular position; and (g) applicability to a person of prohibition to hold relevant position in accordance with the Law of Ukraine “On civil servant screening”.
