Decree No. 169 of the Cabinet of Ministers “On measures to recultivate degraded lands, preserve the fertile layer of the soil and organize its rational use”.

Abstract

The Regulation on the procedure for the recultivation of disturbed lands, extraction, preservation and rational use of the fertile layer of the soil, envisages the application of the following arrangements: (a) the procedure for establishing a commission for recultivation of disturbed lands, determination of disturbed lands and acceptance of recultivated lands, as well as its rights and obligations; (b) procedure for extracting and preserving the fertile layer of land by individuals and legal entities carrying out industrial, construction, and other activities related to the destruction of the soil layer; (c) procedure for accepting and handing over recultivated land after receiving a written notification from natural persons and legal entities about the completion of recultivation works; (d) the procedure for developing a project for the recultivation of disturbed land and carrying out the recultivation at the expense of the natural person or legal entity that caused the disturbance of the land. The Ministry of Natural Resources of the Republic of Uzbekistan, the Ministry of Agriculture and the Ministry of Mining and Geology, the Mining, Geological and Industrial Safety Control Inspectorate within its powers recultivate disturbed lands and restore their productivity, extract and preserve the fertile layer of the soil and ensure effective control and monitoring of the quality and timeliness of its use. Starting from May 1, 2023: (a) the users of the agricultural land allocated for the expansion of the city of Tashkent and cities in other regions and for non-agricultural purposes will extract the fertile layer of the soil from these land plots and ensure that they are delivered to the land areas where they will be used, and recultivation works will be carried out; (b) during the period of recultivation of degraded lands intended for agriculture, development of projects for the designation of protected areas of infrastructure objects, and during the period of relocation of the project, authorship control shall be carried out by the State Scientific-Design Institute of the Ministry of Agriculture of the Republic of Uzbekistan "Uzdaverloyiha" and its regional divisions; and (c) recultivation activities and design works of agricultural lands damaged due to overturning of mining resources, as well as due to the construction of infrastructure objects (roads, pipelines, electric networks) are carried out at the expense of natural persons and legal entities who built these infrastructure objects. The Ministry of Agriculture of the Republic of Uzbekistan, together with the relevant ministries and agencies, shall ensure that prior to August 1, 2023, the database on the state of agricultural land contained in all categories of the land fund, including disturbed and recultivated land, shall be kept in the "Geoinformation" system of the Ministry of Agriculture.
