Abstract This Decree, consisting of 29 articles, regulates the granting of rights to use water resources within the State of Mato Grosso do Sul. It specifies that surface and ground waters under the jurisdiction of the State of Mato Grosso do Sul, as defined in art. 7 of the State Constitution are subject to the granting regime of right to use water resources, as established by the State Law No. 2.406, of 29 January 2002, according to the rules established. Activities under the granting regime are: derivation or captation of a portion of existing water in a body of water for final consumption, including public supply or input of the production process; extraction of aquifer water to final consumption, including public supply or input of the production process; water discharge and other liquid or gaseous waste for the purpose of dilution, transport or disposal; exploitation of hydroelectric potential; other uses that may change system, quantity or quality of existing water in a body of water.
