Abstract

This Regulation establishes that the right of commercial fisheries in fishing areas allocated in the in the Aidar-Arnasai Lake System shall be granted to fishing enterprises – winners of the competitive tender that have concluded in accordance with the established modalities lease contact for management of waterbody. Directorate of the Aydar-Arnasai Lake System after identification of fishing areas subject to allocation to fishing enterprises, shall release the following information: (a) number of fishing area (contour) of the water reservoir (waterbody); (b) coordinates of the location of the water body; (c) defined area of the waterbody; (d) map-diagram of the section of the water reservoir (waterbody) and (e) information on the average fish productivity of the fishing area subject to allocation. The fishing enterprise have the right: (a) to use the allocated fishing area of the reservoir in accordance with the concluded contract; (b) at its own discretion trade caught fishes; (c) to create subsidiary farms outside the water protection zone for the production of fodder and other products related to basic activities, as well as fish processing and the manufacturing of fish products. Fisheries can also have other rights in accordance with the law. Fishing enterprise shall have the duty: (a) to comply with the requirements of environmental legislation when performing fisheries; (b) to fulfill the terms of the contract, including the plan of integrated measures for nature protection, submitted when applying for participation in the tender; (c) to carry out commercial fishing within the limits of the water body indicated in the certificate attached to the contract; (d) must not transfer to the third parties the allocated fishing area or part thereof; (e) to mark fishing gear; (d) to perform annual stock enhancement and repopulation, as well as other measures to ensure the safety of fish resources; and (e) register daily catch in a fishing log.
