This Decree enters into force on the day of its publication.
Abstract

This Decree regulates art. 10-B of Law No. 11.445 aimed to establish the methodology for verifying the economic-financial capacity of two providers of public services for potable water supply or sanitary drainage that have regular contracts in force, with a view to make viable or fulfill the goals of universalization provided for in art. 11-B of Law No. 11.445 of 2007. Services that must verify the economic-financial capacity are: I - the service providers that are exploring based on the program contract entered into in the terms of the Law No. 11.107 of 6 April 2005; and II - the service providers that are explored on the basis of a contract, preceded by a tender and entered into with the holder of the service, of a common concession governed by Law No. 8.987 of 13 February 1995, or of a sponsored or administrative concession governed by Law No. 11.079 of 30 December 2004, for the purpose of adding two contracts to include the goals of universalization.
