Abstract

This Decree, as in accordance and for the purposes of the Bulgarian Water Act, here adopts the Ordinance on the use of surface waters. The adopted Ordinance shall regulate the following: 1. the use of surface waters and surface water bodies in accordance with the requirements of the Water Act (WA); 2. order and conditions for issuing permits for use of the surface waters and the surface water objects under art. 44, 46 and Art. 140, para. 7 of the WA; 3. requirements to the documents for issuing permits for use of surface waters and surface water objects; 4. the requirements to the content of the statements issued by the directors of basin directorates under art. 155, para. 1, item 23 of the Law on Eligibility of Investment Proposals, which are subject to a procedure under Chapter Six of the Environmental Protection Act (EPA) and / or under Art. 31 of the Biodiversity Act (BDA), for their compliance with the River Basin Management Plan (RBMP) and / or with the Flood Risk Management Plan (RMP); 5. the order and the manner for management and use of the dams and the thresholds in the uncorrected sections of the rivers outside the borders of the settlements and the settlement formations, as well as of the facilities, which have lost their original purpose; 6. the control over issued permits for use of the surface waters and the surface water objects; 7. the content of the registers under art. 182, para. 1, item 1, letters “a” and “g”, items 3, 4 and 5 and Art. 183, item 1 of the WA on: a) the permits for use of surface waters and surface water bodies issued by the Minister of Environment and Water, the directors of basin directorates, the mayors of the municipalities and the executive director of the Executive Agency "Research and Maintenance of the Danube River"; b) the coordinated notifications for performance of each of the activities under art. 58, para. 1 and under Art. 44, para. 3 of the Law, the prescribed conditions and restrictions; (c) the requirements, conditions or prohibition for a particular type of water abstraction or use; (d) points and stations for monitoring the quantity of surface water. The ordinance shall not regulate the use of surface water objects for discharge of waste waters.
