This Decree-Law enters into force on the day after its publication.
Abstract

This Decree-Law, consisting of 49 articles divided into and seven Chapters and four Annexes, establishes the legal regime applicable to the trading of licences and the emission of greenhouse gases, transposing for the national legal order the Directive (EU) 2018/410. It applies to fixed installations that carry out activities, referred to in Annex II, which result in the emission of GHG identified in Annex I to this Decree-Law, without prejudice of the provisions of Chapter II of Decree-Law No. 127/2013 of 30 August, which establishes the industrial emissions regime (REI) applicable to the legal regime for integrated pollution prevention and control. This Decree-Law does not apply to installations or parts of installations used for research, development and testing of new products or processes, as well as those installations that develop only the combustion activity and that use exclusively biomass, including equipment using fossil fuels only during start and stop situations.
