Abstract

This Corrective actions policy developed by the Extended Commission for the Conservation of Southern Bluefin Tuna (CCSBT) is a multilateral document aiming at (i) bringing all Members, including Cooperating Non-Members (CNMs), into compliance with their CCSBT obligations by setting out a framework to respond to evidence of non-compliance by a Member; (ii) assisting Members to achieve capacity to effectively comply with CCSBT obligations. Non-compliance with Members’ obligations can arise due to three main sources (1) administrative failings; (2) failure by Members to take action against non-compliance by one of the concerned parties; (3) deliberate actions to avoid meeting obligations. To determine the corrective action shall be followed the guidelines provided in point 3. The corrective actions list included in the document sets out the following possible measures (i) Compliance assistance/capacity building programs; (ii) Quota pay back; (iii) Quota reductions in national catch allocations; (iv) Increased monitoring requirements; (v) Public disclosure; (vi) Trade or market restrictions consistent with international law. The Member has the opportunity to suggest corrective actions or remedies to improve their compliance with CCSBT obligations.
