Entry into force notes
The Regulations shall enter into force on the date of publication in the Official Gazette of the Republic. Exception to this rule make the provisions of regulation No. 8 (paragraph 2), No. 9 (paragraph 3), No. 10 (paragraph 5) and No. 18, which shall come into force on such date as the Cabinet of Ministers may, by Notice in the Gazette, determine.
Abstract

With the purpose of aligning the Cypriot legislation with Council Directives 94/66/EC and 90/656, both amending Directive 88/609/EEC on the limitation of emissions of certain pollutants into the air from large combustion plants, the present Regulations aim to combat air pollution from large combustion plants and provides for the adoption of certain measures and procedures in order to prevent or reduce air pollution deriving from such facilities. In particular, the Regulations set forth the obligation of the competent authority to ensure the reduction of emissions of certain pollutants (sulfur dioxide, nitrogen oxides and dust) deriving by the operation of large combustion plants (thermal input rate equal to or greater than 50MW, regardless of the type of fuel used). These emissions should not exceed certain limits set out in the Regulations in order to avoid air pollution. In general, these Regulations provide that the large combustion plants must obtain a waste gas emission permit from the competent authority. Permits are granted once the competent authority has ascertained that all necessary measures to protect public health and the environment have been taken and that the best technology available has been used. Under these Regulations the operators of such industrial plants are required to comply with the emission limit values as set out in the Annexes to the Regulations and included such values in the permit. The competent authority with regular and extraordinary inspections shall ensure compliance with the permit conditions and impose penalties where there is a breach of such terms. The Regulations also include the obligation of the competent authority to prepare an annual report on the state of operation and emission of pollutants into the atmosphere from large combustion plants in the Republic and to transmit it for information to the European Commission.
