Conditions of Ornamental Fish Import License under Section 8(1) Fisheries Order, 2009.

Abstract

This Regulation, consisting of 15 articles, provides for the rules to be met to import ornamental fish, in particular, it establishes that (i) importers must be registered with the Department of Fisheries of the Ministry of Primary Resources and Tourism; (ii) they must have a valid ornamental fish import license; (iii) the ornamental fish species to be imported shall be included in the one listed in the approved ornamental fish import licence; (iv) it is prohibited to release any imported ornamental fish into Brunei Darussalam waters including any river, stream, canal, channel, watercourse, reservoir, lake, or other body of water; (v) importers must comply with fish disease control measures; (vi) importers must ensure that the consignment is accompanied by a Health Certificate, Certificate of Origin, Fish Import License, CITES export permit, CITES import permit (if listed under CITES); (vi) they must allow the Department of Fisheries to carry out inspection and sampling of ornamental fish imported for disease analysis (article 12 defined the procedures to be followed in case of positive result); (vii) importes must comply with and practice the Pollution Control Guidelines for Industrial Development; (viii) they must provide the details of each import of ornamental fish to the Department of Fisheries for the purpose of record keeping. Article 4 lists the ornamental fish the importation of which is prohibited, namely (i) piranhas; (ii) all species of sharks.
