Based on Article 107(3)(b) of the Treaty on the Functioning of the European Union it enables Member States to use the full flexibility foreseen under State aid rules to support the economy, while limiting negative consequences to the level playing field in the Single Market. In regard to Fishery, aquaculture and agriculture, Section 3.1 allows Member States to support affected fishermen and aquaculture producers by allowing aid up to a level of EUR 120,000 per undertaking through direct grants, repayable advances or tax advantages. The Commission will consider such State aid compatible with the internal market on the basis of Article 107(3)(b) TFEU, provided that all the specified conditions are met.
