Coastal waters of the State do not include Territorial Sea beyond 3 nautical miles (subsect. 4(2)). Legislative powers conferred by the Northern Territory (Self-Government) Act 1978 may be used to enact laws relating to matters set out in section 5. Fisheries in Australian waters beyond the outer limits of the coastal waters may be regulated by the Territory insofar as being fisheries which may be managed by the Territory under an arrangement with the Commonwealth (subsect. 5(c)). Nothing in this Act affects the status of the Territorial Sea of Australia under international law or the rights and duties of the Commonwealth in relation to ensuring the observance of international law (sect. 6).
