Section 2 states that a person must not, in the course of a business or the activities of a charity or non-profit organization, supply or offer to supply to an end user a prohibited single use plastic item. An offence is not committed if the person supplies or offers to supply a) an excluded bag; b) compostable plastic; or c) an exempt item. Under Section 3 a person must also not use microbeads as an ingredient in the manufacture of any rinse-off personal care product, moreover a person must not supply, or offer to supply, any rinse-off personal care product containing microbeads. Under the Schedules 1 the Regulation identifies exemptions for single use carrier bags, plastic straws and single use plastic stemmed cotton buds.
