Abstract

This Circular concerns environmental protection as regards to the appraisal and implementation of foreign direct investment projects. The licensing of investment projects will be dependent on the results of environmental assessment reports. When submitting an investment licensing application, investors must prepare an explanatory report describing any factors that may have an environmental impact. It is on this basis that the relevant State management agency will give consideration when appraising the project file. The appraisal note made in respect of the assessment report acts as the basis for obtaining construction permits. The State agencies will also be responsible for environmental protection inspection following construction. The project investors must undertake any necessary measures to comply with requirements if the project does not meet the approved environmental requirements. Under section 3, an assessment report on environmental impact shall contain information such as a brief description of the project, the possible impact of the project on environmental factors and impacts on factors related to the living standards of people. The report also outlines the proposed solutions for the protection of the environment following completion of the project (sect. 4).
