Abstract

This Act vests specified land in the British South Africa Company Limited and makes provision for certain rights of the Company, the President of Botswana and the Minister in respect of that land. Lands vested in the Company are specified in the First and Second Schedule. The Company may grant lands vested in property, mortgage or otherwise, provided that no occupation or ownership of any such lands shall be recognized as valid or legal unless a title has been granted to the owner or occupier in such form as the Minister shall prescribe. The Minister may grant roads or right of way on the land or establish a public outspan. The Minister may also enter the lands or authorize another person to enter the land. The President may make an Order: (a) requiring the land for any public purpose and to grant titles in land to any person or corporation; and (b) to impose such taxes in respect of the ownership or occupation of the lands concerned. No compensation shall be payable for any land taken under this Act unless such land has been improved by cultivation, irrigation, or otherwise.
