The latter is defined as the part of an aquifer in which all interconnected openings within the geological formation are completely filled with water. As a general rule, regulation 4 stipulates that the drilling of a borehole or any form of excavation works carried out partly or totally within the saturated zone is prohibited, unless a permit to this effect is issued by the Malta Resources Authority. Further provisions concern the application to obtain this permit.
