Abstract This Act aims to legislate separately on patent matters by repealing the patent provisions of the Patents And Designs Act, 1911. Any technological product or process invention shall be patentable if it contains novelty and innovative step and is applicable in industry. Novelty shall be deemed to exist in an invention, if it is not conceivable by a known prior. An invention shall be deemed to contain an inventive step if it indicates a substantial technological advance of knowledge, which is beyond the scope of the existing knowledge or prior art and the claimed invention is not clearly apparent to a person skilled in that particular technology. Any work which can be applied or used in industry shall be deemed to be an invention. he patent interests or rights of the inventor shall be reserved. If two or more persons jointly make an invention, such persons shall be jointly entitled to the patent. If two or more persons independently make the same invention, the person who applies for the patent first shall be entitled to the patent and in case of priority claim , the priority date shall be deemed to be the date of patent application.
