Abstract This Act consists of 44 sections and Schedule A, and concerns aquatic produce, particularly aquatic plants, animals and animal products bred for specific genetic characteristics different from other members of the same species (sect. 1.2). It does not cover laboratory-bred species used for experimental purposes (sect. 1.1), and can be retroactively applied (sect. 3.1). Aquaculture is prohibited without a licence, and the basic procedures for application, renewal and amendment are outlined (sects. 4-10). A Registrar for licensing is appointed, and even post-issuance, the Registrar may change licence terms and conditions (sect. 38). Examples of this are if the Registrar considers the situation to danger public health or the environment; there is the potential of stock depletion or the spread of fish disease, parasites, toxins or contaminants; and to ensure health, grade and genetic standards (sects. 11.1 and 38). A license shall specify the contents, length of time, specific site and the types of plants and animals cultivated (sects. 12-16), and the Registrar has the right to destroy aquatic output that not specified in the licence (sect. 16.3).
