Abstract

This Chapter of the North Dakota Century Code concerns appropriation of water. Specifically, it provides that a right to appropriate water can be acquired for beneficial use only as provided in this Chapter. Beneficial use shall be the basis, the measure, and the limit of the right to the use of water. The Chapter defines "beneficial use" as a use of water for a purpose consistent with the best interests of the people of the state. It further provides for permit for beneficial use of water required; emergency or temporary authorization of use of water; application for water permit; limitation on amount of water; other permit-related procedures and rights; prescriptive water right; forfeiture of water rights; and enforcement, penalty and damages for illegal diminishment of water supply.
