Abstract

These Rules, issued by the Director-General of the Department of Fisheries under paragraph 1 of section 82 of the Fisheries Ordinance of 2015 concern procedures for filing documents with the competent official before taking a commercial fishing boat out of a fishing port. The master of the fishing vessel shall report to the competent official on documents as specified regarding the fishing vessel including, among other things: (1) Thai vessel registration (2) license (3) Vessel Master's Certificate (4) Ship Engineers Certificate (5) fishing license (6) Naval Control Officer Card (7) boat engine ID card or identity card of non-Thai nationality (8) In the case of a boatman who is not a Thai national, permit to stay in the Kingdom and work under the law governing the employment of foreigners (9) record of Vessel Tracker Installation (VMS) (10) certification of occupational hygiene and welfare of the ship's personnel. The fishery operator shall take the documents to the Employee Officer at the Port In‐Port Out Controlling Centre before taking the boat out of the port. Section 82 stipulates that, in the case where the owner or the master of a fishing vessel fails to submit the documents and evidence pursuant to paragraph one, or the provision of a system for ensuring occupational safety, hygiene and wellbeing of seamen does not comply with the requirements stated in the Ministerial Regulation, the competent official shall order the detention of the fishing vessel at the fishing port or order the return of the fishing vessel to the fishing port.
