This Act lays down rules for the (I) establishment and functions of the Animal Movement and Disease Advisory Council and the Veterinary Authority; (II) designation of any diagnostic, research or other laboratory as an official or reference laboratory; (III) designation of areas, offices, laboratories or other premises for a specified purpose or generally for the administration of this Act; (IV) designation of veterinary inspectors; (V) establishment of the animal disease surveillance system; (VI) declaration of infected zone to prevent a serious threat to animal, human or environmental health; (VII) declaration of animal disease emergency based on risk assessment and limited to the extent necessary to minimize the threat; (VIII) development of emergency and contingency plans; (IX) designation of free zones, containment zones, free compartments and surveillance zones; (X) segregation and notification of diseased animals; (XI) movement permit issued by veterinary inspector; (XII) slaughter of diseased animals to prevent the spread of any animal disease; (XIII) disposal of animals which are killed or died as a result of disease in accordance with the standards of the OIE; (XIV) registration of veterinary medicinal products for the purposes of import, sales, distribution, manufacturing, and usage; (XV) designation of international border inspection point as import entry or export point; (XVI) requirements for the export and import of animals, animal products and animal related items; (XVII) application procedures for import and export permit; (XVIII) restriction on importation of an animal, animal product or listed animal-related item; (XIX) inspection on imported goods by the customs officer; (XX) transport of animals; (XXI) procedures and principles of animal quarantine; (XXII) prohibition of maltreatment to animals to ensure animal welfare; (XXIII) duties and authorities of veterinary inspector; (XXIV) storage and removal of seized animals; (XXV) terms and conditions for the detainment of animal, animal product or animal-related item; (XXVI) disposal of infected or contaminated animal, animal product or animal-related items; and (XXVII) offences and penalties. This Act shall apply to any mammals, birds and poultry, fish, reptiles, amphibians, eggs of any kind of animal, and genetically engineered domestic or wild, terrestrial or aquatic animals. The Minister shall have primary responsibility for the administration of this Act. To this end, the Minister shall declare a state of disease emergency, declare a free zone, designate veterinary inspectors, designate official and reference laboratories, make regulations under this Act; and carry out other tasks as prescribed by this Act. The animal health measures approved for the purposes of this Act shall be pursuant to the harmonization with the international standards, risk assessment and science-based measures, regionalization, and least-trade restrictive, necessary and proportional to the risk. For the purposes of controlling or eradicating animal diseases and to prevent the introduction or spread of animal diseases, the Veterinary Authority shall take control measures. Moreover, the Veterinary Authority shall set up a system for the identification and traceability of animals and shall collaborate with the authority responsible for food safety with regard to the traceability of animals and animal products to be used as food for human consumption. The standards for animal health and welfare applied in the Act and regulations made under this Act shall be consistent with the standards of the OIE and the Codex Alumentarius Commission.
