Abstract

Authorised representatives of the state bodies of state power of the Russian Federation and the bodies of state power of the Sakhalin Region have agreed on the following: 1) The State Bodies of the Russian Federation and the State Bodies of the Sakhalin Region jointly are authorized to: a) regulate issues of the development of agro-industrial complex of the Sakhalin Region, development and improvement of soil fertility; b) regulate issues of prospecting and rational use of mineral sources of raw materials, aquatic biodiversity and other natural resources on the territory of the Sakhalin Region, including those of the continental shelf and 200-mile economic zone of the Russian Federation in accordance with federal legislation; c) regulate issues of reproduction and rational use of mineral sources of raw materials, prospecting and exploitation of recreational resources; d) regulate issues regarding prevention of disasters and liquidation of their consequences; e) certify and license some types of activity on the territory of the Sakhalin Region. 2) The following issues are within the jurisdiction of the Russian Federation and its State Bodies: a) elaboration with the participation of the State Bodies of the Sakhalin Region of normative legal acts pertaining to joint jurisdiction in accordance with the provisions of the present Treaty; b) elaboration and validation jointly with the State Bodies of the Sakhalin Region of federal special programs regarding liquidation of the consequences of disasters and all-round development of the region, including development of agro-industrial complex. 3) The state bodies of the Sakhalin Region, for the purpose of implementation of the present Treaty, must establish, in accordance with federal legislation, conditions of licensing for use of natural resources and other types of activity on the territory of the Sakhalin Region, take part in the realization of federal programs of development of mineral sources of raw materials, structural re-organization of economy and development of agro industrial complex. Delimitation of natural resources on the territory of the Sakhalin Region, including aquatic biodiversity within continental shelf and 200-mile economic zone of the Russian Federation between federal and regional property must be carried out on the basis of separate agreements.
