Abstract This Act, as in accordance with the provisions of the Council Regulation (EC) No 428/2009 of 5 May 2009 setting up a Community regime for the control of exports, transfer, brokering and transit of dual-use items, regulates the measures for controlling dual-use items in that part which the regulations of the European Union governing this field do not cover, or where such regulations authorize Member States to further regulate this sphere in their national regulations. The measures of control of dual-use items refer to exports, transfer within the customs territory of the European Union, transit, brokering, provision of technical assistance and the issuing of certificates related to imports of dual-use items. Dual-use items’ shall mean items, including software and technology, which can be used for both civil and military purposes, and shall include all goods which can be used for both non-explosive uses and assisting in any way in the manufacture of nuclear weapons or other nuclear explosive devices.
