The Act applies to genetically modified organisms for which cultivation permits have been granted in accordance with Part C of Directive 2001/18/EC of the European Parliament and of the Council on the deliberate release of genetically modified organisms into the environment or Chapter II or III of Regulation (EC) No 1829/2003 of the European Parliament and of the Council on genetically modified food and feed, hereinafter the Regulation on genetically modified food and feed. The Ministry of Agriculture and Forestry controls and supervises compliance with this law and the regulations issued under it. The Act defines duties of various authorities in respect of cultivation permits. The Ministry may prohibit or restrict cultivation, but limitations or prohibitions must be compatible with EU law, justified, proportionate and non-discriminatory and based on compelling circumstances (examples are given).
