This Act entered into force on 1 October 2002.
Abstract

The purposes of this Act are to protect human health and the environment from detrimental effects of ionising radiations, regulate the implementation of nuclear safety measures and determine the organization of the administrative bodies. The Act is divided into 16 Parts. Part 1 gives definitions, basic principles of the Act, and provides for the appointment of expert councils. Part 2 sets out provisions for obtaining permits to carry out practices involving radiation and to use radiation sources. Part 3 provides for the protection of people against ionising radiation, obligatory measures related to dose limits, measures aimed at reducing radiation exposure in the workplace, etc. Part 4 deals with radiation and nuclear safety in facilities, which shall be classified into nuclear facilities, radiation facilities and less important radiation facilities. A permit must be issued by the ministry responsible for the environment for the construction, reconstruction or removal of a facility. Provisions are set out for handling radioactive waste and spent fuel (arts. 93 to 99), and for the import, export and transit of nuclear waste and spent fuel (arts. 100 to 103). Part 5 deals with the issuing, renewal, amendment, withdrawal and expiry of permits. Measures for physical protection of nuclear substances and nuclear facilities are provided for in Part 6. Part 7 deals with the non-proliferation of nuclear weapons and the protection of nuclear materials. The monitoring of radioactivity levels in the environment shall be ensured by ministries responsible for the environment, air, waters, health, foodstuffs, animal feed, etc. as provided for in Part 8. The remaining Parts of the Act deal with the following: reports on protection against radiation; records containing information on radiation sources and practices involving radiation; financing of the protection against ionising radiation and nuclear safety; compensation for the limited use of land due to a nuclear facility; administrative tasks and inspectorate control; and, penal provisions.
