Abstract

This Act, consisting of 42 articles, divided in 8 Chapters, concerns management and protection of the animals and plants naturally occurring on the public entities of Bonaire, St. Eustatius and Saba and in their waters and provides for the implementation of related international obligations. Chapter II defines: duties and powers of the Minister of Agriculture, Nature and Food Quality, including: elaboration of a nature Policy Plan containing nature conservation values, a list of terrestrial and marine national parks, nature and landscape priorities; keeping of registers of species; appointment of experts and scientific authorities; measures related to trade in terrestrial and marine species, in compliance with provisions of international conventions; the identification of endangered species. Chapter III defines duties and powers of the public entities Bonaire, St. Eustatius and Saba and their Executive Council, including: implementation of control measures for the protection of species; protection of biological diversity, responsible use of its components and the fair and equitable distribution of the benefits arising from the use of genetic resources. Further Chapters concern: surveillance and investigation; sanctions; final and transitional provisions.
