The Act enters into force from the date of its official publication.
Abstract

The Waste Management Act No. 238/1991 is amended by this way: 1) The second sentence in the Article 2 par. 1 is removed. 2) The words "the Czech and Slovak Federative Republic" are replaced in Article 3 par.4 in the first sentence, subpar. c), Article 3 par.7, Article 4 par. 1 subpar. g) by the words "the Slovak Republic". 3) The words "Czechoslovak party" in Article 3 par.4 subpar. a) are removed. 4) The words "the Czech Republic or" in Article 3 par. 4 subpar. b) and in par. 5 are removed. 5) Subpar. d) in Article 4 par. 1 is removed. In the same time the markings of next subparagraphs is changed. 6) Article 4 par. 2 is supplemented by the new subpar. d) that reads: "d) for the business activities in the field of the waste management.” 6) Article 11 par. 1 is supplemented by the new subpar. h) that reads: "h) does not meet the measure aimed at the abrogation of the illegal status that has been imposed according to Article 4 par. 4 subpar. c).” 7) In Article 11 par. 2 subpar. b) the word "allowances" is replaced by the word "consent" and the words "by this allowance" by the words "by it". 8) The word "allowances" in the Article 11 par. 2 subpar. c) is replaced by the word "consent". 9) Article 11 par. 2 is supplemented by the new subpar. e) and f) that read: "e) maltreats the hazardous waste without consent of the concerned state administration authority according to Article 4 par. 1 letter b) carries out the transit of waste across the territory of the Slovak Republic without consent of the concerned state administration authority according to Article 4 par. 1 subpar. g)." 10) In Article 11 par. 3 subpar. d) the words "with allowance" are replaced by the words "with consent" and the word "allowances" is replaced by the word "consent". 11) Present text of Article 13 is marked as par. 1 and is supplemented by the new par. 2 that reads: "(2) The categorization and the catalogue of waste shall be declared by the Order of the Ministry of Environment of the Slovak Republic by agreement with the concerned central state administration authorities.” 12) Article 15 par. 2 reads: (2) The time period, within which the special conditions can be enacted, must not exceed a) July 31st, 1996 for the cases given in the Article 5 par. 1 subpar. b) and c); b) July 31st, 2000 for the cases given in the Article 5 par. 1 subpar. e) and f) and in the Article 15 par. 1 subpar.
