Abstract

This German federal law serves as an implementation of EU Regulation No 511/2014 of the European Parliament and Council of 16 April 2014 on compliance measures for users from the Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing of Benefits Arising from their Utilization in the Union. The law has 7 sections, divided into section 1 tasks and powers, section 2 orders and remedial action, section 3 empowerment to issue statutory instruments, section 4 regulations on administrative fines, section 5 confiscation, section 6 competences and section 7 expenditures. The act serves to implement Germany’s state obligations under the Nagoya protocol, as Germany is a binding party, as well as transpose the European Union Regulation into its national legal system.
