It applies to purchase of agricultural and food products if the buyer or supplier is established in Sweden and the buyer: 1. Has an annual turnover of more than EUR 2 million; or 2. is an authority established in the European Union. The Act does not apply to consumer purchases. Section 5 contains a list of prohibited trading practices, which include the cancelling of an order with less than 30 days notice; unilaterally enforcing a change in the terms of an agreement; requiring payment from the supplier for things that are not linked to the supplier's sales; not complying with the supplier's request to receive a written confirmation of the terms of a contract; etc. Section 12 contains a list of trading practices that are prohibited unless the parts have clearly agreed otherwise. The Act contains rules on supervision, offences and penalties.
