50 CFR § 402.01-402.48 - Interagency cooperation—Endangered Species Act of 1973, as amended.

This Part of Title 50 of the Code of Federal Regulations provides with respect to consultation and other relationships between the Fish and Wildlife Service or the National Marine Fisheries Service and other federal agencies in authorization of actions in respect of endangered species and critical habitats and provides that requirements of section 7 of the Endangered Species Act and the requirements of this Part apply to all actions in which there is discretionary Federal involvement or control. Consultation, conference, and biological assessment procedures under section 7 may be consolidated with interagency cooperation procedures required by other Statutes, such as the National Environmental Policy Act or the Fish and Wildlife Coordination Act. A Federal agency may designate a non-Federal representative to conduct informal consultation or prepare a biological assessment.
