Abstract

This Part of Title 50 lays down regulations to establish procedures relating to property seized or subject to forfeiture under any of the following laws: (a) Eagle Protection Act; (b) National Wildlife Refuge System Administration Act; (c) Migratory Bird Treaty Act; (d) Migratory Bird Hunting Stamp Act; (e) Airborne Hunting Act; (f) Black Bass Act; (g) Marine Mammal Protection Act; (h) Endangered Species Act; and (i) Lacey Act; and (j) Lacey Act Amendments of 1981. The regulations provide for the disposal of any wildlife or plant forfeited or abandoned by one of the following means: (I) return to the wild; (II) use by the Service or transfer to another government agency for official use; (III) donation or loan; (IV) sale; or (V) destruction. § 12.37 prohibits to sell or offer for sale of any species listed as a migratory bird protected by the Migratory Bird Treaty Act, protected under the Eagle Protection Act, listed in ‘‘Appendix I’’ under the Convention on International Trade in Endangered Species of Wild Fauna and Flora, listed as ‘‘endangered’’ or ‘‘threatened’’ under the Endangered Species Act of 1973, or protected under the Marine Mammal Protection Act.
