Abstract

Damage of wheat crop – harm to the plantations – guarding wild animals (pigs) – state liability.


As long as the state intentionally allowed wild pigs to live on its land, and issued laws to protect them and hunt them. It is necessary to take safety measures to protect them and prevent them from making any harm. The court established from the case documents that these animals infiltrated the land of the person harmed and destroyed the crop as stated in the legal expert conclusions. Consequently, the state stands liable according to the provisions of article 87 of the obligation and contracts code.
