Abstract

The Supreme Administrative Court found that the Department of Pollution Control failed to perform duties as required by law to restore and extinguish lead contamination in Klity Creek which directly resulted in the inability of the Plaintiffs who were villagers living near the Creek to use and benefit from the Creek. The Court therefore decided that the Department of Pollution Control shall undertake actions to restore the water and the environment of the Creek until it was found that lead contamination did not exceed the stipulated standards. The Court further required the Department to pay for damages caused to the Plaintiffs.
