Abstract

Local communities used the canal “Klong Sai Thanu” as a waterway to drain water from the area, also with help from the extra drainage system. The expressway authority filled the canal to build the expressway and then built a substitute canal, but without an extra drainage system, thus failed to drain water from the area, resulted in flooding, stink water, which in turn became a source of diseases.

The court found the failure of the defendants to build an extra drainage system, which resulted in damages to local people, wrongful (tort) and demanded reparation by building an extra drainage system.
