Abstract

This case is an application for an order directing the commissioning of an environmental impact assessment in terms of the Environment Conservation Act 73 of 1989, alternatively in terms of the National Environmental Management Act 107 of 1998. It is pursuant to land use that applicants approached this Court for an order in the following terms: that first respondent be ordered to commission a full and independent environmental impact assessment (EIA) process in terms of the regulations issued under s 21 of the Environmental Conservation Act 73 of 1989 (ECA); alternatively in terms of the general environmental policy determined pursuant to s2 of the said Act; alternatively in terms of the provisions of s 24 of the National Environmental Management Act 107 of 1998, in respect of the planting of a vineyard and construction of dams on Farm 1000 and Farm 1404, Simonstown. The judge dismissed the application.
