Abstract

As long as the defendant denied his intention to set fire in the forest and confirms that he only forgot to put it off after making tea, the court was right to reconsider the legal description of facts and apply the appropriate description which is provisions of Article 607 of the criminal code instead of Article 581 of the same code, on the ground that there is a lack of criminal intent.
