Abstract

In this case, the Ministry of Environment has taken a decree ordering the eviction of all the lands in protected areas that are illegally occupied by civil populations. The decree has been implemented during a joint operation from the army and from the police who also destroyed the plantations of the neighbouring village of Kouamé Kouassikro.

The farmers of the Kouame Kouassikro sued the Ministry of Environment in front of the Administrative Chamber of the Supreme Court on the basis that the eviction was not legal and asked for damages for the destruction of their plantations. The Supreme Court considered that the decree could not be challenged because it has already been implemented and that it was not competent to decide on the damages because the demand should be made through a civil procedure.
