Abstract

In this case, the plaintiff is a logging company which challenges a decision taken by the Ministry of Environment which withdraws the forestry exploitation permits of the plaintiff on a specific forest parcel.

The plaintiff motivates this challenge of the decision by stating that the decision was arbitrary and illegal. The Supreme Court accepted the appeal and noted that the Ministry had motivated its decision by the fact that the forestry permit could create some social troubles and did not respect the administrative procedure. However, the Court considered that the Ministry of Environment did not show any evidence of public disorders or of any irregularities within the administrative procedure. As a result, the Supreme Court considered the decision of the Ministry to lack motivation and cancelled it.
