Cornwall Council Country/Territory United Kingdom Date Dec 1, 2013 Source UNEP, InforMEA Court name High Court of Justice Seat of court England and Wales Reference number [2013] EWCA 3958 Abstract Local council granted approval for the construction of a wind farm despite visual landscape impacts because of the need for renewable energy sources to reduce greenhouse gas emissions. Local residents and others challenged the permit alleging that revocation of a policy document required the local council to reconsider its approval. The court dismissed the appeal finding that the planning policy changes did not warrant reconsideration of the proposal and that all procedural requirements were fulfilled.Key environmental legal questions:Challenge the permit approval for the construction of a wind farm Full text climatecasechart.com
