Abstract

The court established that the cause of the damage affecting the plaintiff results from the company’s irresponsible action during sewage treatment which caused the sewage to infiltrate the plaintiff’s land and damaged his agriculture and the well’s water inside his land, based on the technically sound legal exmination report as long as it was not established to the legal expert that the damages in the real estates and the well’s water results from the infiltration of hydrocarbon products (La SAMIR company), and as long as REDAL did not file anything to support this idea, and thus there is not reason to summon LA SAMIR company and the liability of REDAL company stands.
