Abstract

The court based its decision on the assigned expert’s report which concluded that the blacksmith shop, in a residential neighborhood, makes noise, disturbs, and pollutes. Relying on the evidence provided by the local authorities, which had already visited the subject of litigation and ordered its owner to change the profession or stop practicing it, It concluded the existence of harm and ruled to remove it. Consequently, its decision was well founded and well justified.
