Abstract

The case concerned a project aimed at building a natural gas pipeline. The pipeline was 90 kilometres long and 500 millimetres wide in most places. The project required a permit and an environmental impact assessment to be carried out. The environmental impact assessment had been made. The case concerned whether or not a citizens’ organisation with activities in the relevant area had the right to appeal the decision on authorisation for redemption.

 

The Aarhus Convention, especially Article 9.2 was important in the assessment of the case. The court came to the conclusion that the organisation would have the right to appeal the decision.
