Opponents of the legislative decree argue that it violated the rights to be consulted and informed and the collective rights of the indigenous people on their lands provided by the convention 169 of the International Labour Organisation on indigenous and tribal peoples and the UN Declaration of the rights of indigenous people. They consider that the change of the legal framework regulating the titling and the registration of the lands has an important impact on indigenous lands rights and therefore should led to a consultation a priori of the indigenous peoples. The court considered that the legislative decree No 1089 was in line with the constitution and with convention 169 of the ILO because it does not apply to indigenous territories. Indeed, the court point out that in the absence of any specific provisions on indigenous lands within the legislative decree 169, it must be interpreted in the light of the other existing legal instruments on this matter. Therefore, the constitutional judges used the supreme decree No. 032-2008- VIVIENDA to interpret the legislative decree 169 and considered that it is not applicable to land within the indigenous territories.
