Abstract

To support the first instance court’s decision stating that the appellant ploughed a land lot that falls within forests property, the court relied on arresting the appellant, as soon as committing the offence, by the agents of water and forests office, and on the report’s written which is considered as a legal evidence as well as on the conclusion drawn by the legal expert assigned by the court that confirms the fact that the land lot, subject of litigation, falls within forests property of Jbel ALam . the conclusion of the legal expert goes close with to the report made by the agents of water and forests office which was not objected by the appellant, and therefore the court was fully persuaded that the appellant committed what he is being indicted for and consequently its decision has been well founded.
