Abstract
The facts giving rise to this complaint begin with the Commission’s approval of Central Maine Power Company's (CMP) advanced metering infrastructure (AMI) project and associated ratemaking in February 2010. The consumer complaint alleged, among other things, that the Public Utilities Commission (Maine PUC) failed to take into consideration the potential health and safety issues related to radio frequency radiation emitted by smart meters prior to approving CMP’s smart meter installation project. The Supreme Judicial Court of Maine, the State’s highest court, vacated a portion of the Maine Public Utilities Commission order dismissing the complaint. In vacating that portion of the Maine PUC’s order, the Supreme Judicial Court of Maine found that the Maine PUC failed adequately to address the health concerns raised by consumers.
